Guidelines for Commissioning of Surrogacy in India
“With effect from 3rd November, 2015, the Ministry of Home Affairs vide its Circular No.25022/74/2011-F.I(Vol.III) dated 3rd November, 2015 has conveyed WITHDRAWAL of granting Medical Visa to Foreign Nationals intending to visit India for commissioning of Surrogacy and the provisions applicable to OCI/PIO cardholders henceforth.
As such,
i) No Visa will be issued by any Indian Mission/Post to foreign nationals intending to visit India for commissioning surrogacy.
ii) No permission will be granted by Foreigners Regional Registration Officers (FRROs) / Foreigners Registration Officers (FROs) to Overseas Citizen of India (OCI) cardholders to commission surrogacy in India.”

No Objection Certificate (NOC) from the Quarantine Officer at the Animal Quarantine Station in India.2. A duplicate copy of the NOC has to be fixed on the crate of the pet during the air travel.3. Original copy of the NOC has to be produced in India to get the pet released from the customs at the Airport in India.4. 1. 1 The objective of the present guidelines is to provide a sound basis for adoption within the frame work of the norms and principles laid down by the Supreme Court of India in the series of judgments delivered in L.K. Pandey vs. Union of India and Others between 1984 and 1991.
1.2 Adoption undoubtedly offers an important avenue for the care and protection of an abandoned, destitute or neglected child in a family setting and provides an atmosphere of happiness, love and understanding for the realization of his/her talents and potentials. 2.1 In the Government of India all matters relating to adoption shall be dealt within the Ministry of Welfare. 6. 1 A foreign social/child welfare agency desirous of sponsoring applications of foreign adoptive parents for adopting an Indian child shall make an application for enlistment with CARA in the office of India's Diplomatic Mission in that country and only such foreign agencies enlisted for this purpose by CARA shall undertake this activity.

6.2 The criteria for enlistment of foreign agencies by CARA for the purpose of inter-country adoption are as under:-
(i) It shall be either a part of the Government of the country or a duly registered voluntary agency registered under the, relevant law of the concerned country and should be recognized by the appropriate authority of that country.
(ii) It shall be a child welfare agency having an established standing in this field and it must be staffed with qualified social workers who have experience in the filed of adoption.

Voluntary Coordinating Agencies (VCA)
7.1 There shall be a centralized agency namely Voluntary Coordinating Agency (VCA) in the State or even in a large city where there are several recognized placement and child welfare agencies. The principal functions of VCA shall be as follows:-
(a) It shall actively promote Indian adoption and formulate, develop and execute programs and activities for generating awareness in this regard;
(b) It shall ensure that the priority laid down by the Supreme Court on placement/adoption within the country or with Indian abroad is adhered to. All recognized social/child welfare agencies, Juvenile Welfare Boards and Government homes within the country, desirous of placing children in adoption/ placement shall furnish lists of children legally free for adoption to the concerned VCA and also to CARA;

8. 1 It is open to the Court looking into the matter of appointment of guardian under the Guardians and Wards Act, 1890 in exercise of its powers under Section 11 to appoint any independent, reputed Social or Child Welfare Agency, as a Scrutiny Agency for scrutinizing an application from prospective adoptive parents for adoption of a child. The agency must be a body of experts in the field of ChildCare and Welfare, not itself involved in any manner in the placement of children in adoption. At present there are two scrutinizing agencies, namely, Indian Council for Social Welfare and Indian Council of Child Welfare being appointed by the Court. The Court may be requested to appoint any other eligible child or social welfare agency as scrutinizing agency, which preferably meets the eligibility criteria as laid down by CARA.

All Intern Visa holding Foreign Nationals must register with respective FRROs within 14 days of arrival in India, failing which action will be taken against such individuals.

Consulate wishes to clarify on the citizenship status of OCI cardholders. Constitution of India does not allow holding Indian citizenship and Citizenship of a foreign country simultaneously. The Government of India has decided to register Persons of Indian Origin of certain category as has been specified in the Section 7A of the Citizenship Act, 1955 as Overseas Citizenship of India (OCI) Cardholder. It is basically a life long Visa and with some other privileges attached which can be seen on the Ministry of Home Affairs' website. It is reiterated that holding an OCI card in no way entitles its holders to claim the status of dual citizenship.

If any overseas citizen of India of full age and capacity makes in the prescribed manner a declaration renouncing his overseas citizenship of India, the declaration shall be registered by the Central Government, and; upon such registration, that person shall cease to be an overseas citizen of India.
Where a person ceases to be an overseas citizen of India under subsection (1), every minor child of that person registered as an overseas citizen of India, shall thereupon cease to be an overseas citizen of India.

According to the recent relaxation in requirements for OCI Card Reissue:
(i) OCI cardholder is required to upload ONLINE a copy of the new passport and a recent photo (not more than 30 days old) each time a new passport is issued. The uploading of these documents may be done within three months of receipt of the new passport.

General Information
Renunciation/Surrender Certificate: Indian Citizenship Act does not provide for dual citizenship. As per the Passport Act, it is mandatory for all Indian passport holders to surrender their last Indian passport to the Consulate immediately after acquisition of foreign nationality. It is an offense under the Citizenship Act and the Passports Act for foreign nationals to hold Indian passports. Once Indian passport is surrendered, Consulate will cancel it and return it to the Passport holder along with Renunciation/Surrender certificate. Film Visa: Visa for shooting Feature Films
Film Visa will be issued for shooting of feature film/reality TV show and/or commercial TV serials. The proposals regarding the shooting of a feature film or television/cinema and reality TV show/commercial TV serial will be processed by the Ministry of Information and Broadcasting,Govt. Of India, New Delhi.
Requirements for Film Visa : the team may be allowed to shoot a feature film wholly or partially, subject to the following condition:
Four copies (04) of the detailed shooting script in case of feature film and detailed concept in case of TV show/TV serials, details of visiting film crew and location of film shooting shall be submitted by the team to the Ministry of Information and Broadcasting (I&B) for scrutiny and clearance.
Copies can either be forwarded directly to Ministry of I&B or through CGI, San Francisco.
I&B Ministry may levy a fee for scrutiny of the application.

Tourist Visa
The Government of India has decided to restore all valid regular paper /e-visa [including long term 10 years tourist regular paper visa and 5 years e-visa] irrespective of its issue date, for the nationals of USA since 16 March 2022. Fresh issue of regular paper long term (10 years) tourist visas has also been restored for nationals of USA.
Maximum stay by a foreigner in India on an e-Tourist visa or regular paper Tourist visa or both in one calendar year shall be restricted to 180 days. Foreign nationals will not be allowed to enter India through land routes on e-Tourist Visa/regular paper Tourist Visa.
It may be noted that it could take up to 5 business days (longer in certain cases) for processing of the visa on receipt of the application in the Consulate, subject to complete submission of documents.
